What Is Mediation?

Mediation is an alternative to litigation. Instead of a judge, a mediator helps guide the parties to an agreement. Both parties should be represented by their own lawyers, and you can resolve nearly any legal issue through mediation.

Mediation is not a cure-all for every problem you may have, however. Your lawyer must understand which cases are suited for mediation and which are not. For example, if you are not getting the information and disclosure you need from the other party, your case might be better served in court. On the other hand, if both parties are motivated to reach an agreement in a respectful and amicable manner, mediation can be beneficial.

In mediation, it is important to remember that the mediator is not a substitute for having your own lawyer. The mediator’s role is to act as a neutral third party, while your lawyer is there to protect your interests through the mediation.
