To obtain a divorce in Ontario, divorcing spouses must meet certain legal criteria. Your spouse cannot simply give you a divorce. Instead, you and your spouse have to qualify. To qualify, you have to establish that there has been a breakdown in your relationship. You establish this by showing that you and your spouse have been separated for at least one year. There are also residency requirements. For example, at least one party has to reside in Ontario for one year prior to the commencement of the divorce. Finally, there are certain legal criteria that have to be met so the judge can conclude that reasonable arrangements have been made for the children.
